1. What Make Art Werk is
Make Art Werk and its AIM system (Art Inventory Management) are a website and inventory management application, created by a digital artist to simplify organising and maintaining your information. It helps artists build their private, and potentially public, archive. It lets you keep artwork records and images, organise your inventory, make catalogues and price lists, export everything in standard formats, and publish what you choose.
It is run by Alessandré Petzer, entrepreneur individuel, Marseille, France (see Mentions légales).
Make Art Werk is not a gallery, dealer, agent, auction house or marketplace. It takes no commission on your sales and does not guarantee sales, exhibitions or other opportunities.
2. Your work stays yours
You keep full ownership of your artwork, your images and everything you upload. Make Art Werk only receives the limited permission it needs to run the service for you: to store your files, make previews, show them where you choose, and produce the catalogues and exports you ask for. Nothing broader, and no right to use your work for anything else.
Make Art Werk holds and organises your records; it never takes over your copyright or your reproduction rights. If you belong to a collective rights society (for example ADAGP), your membership is unaffected.
3. What is public, and what isn’t
Nothing you add is public until you choose. For each work, you decide:
- private: only you, and anyone you invite to help run your workspace
- shared: seen by the people you send a collection or capsule link to
- public: shown on your own page
You can change this at any time. When you unpublish a work, it leaves your page at once; its image can take up to 5 minutes to close.
Make Art Werk may feature artists or works (for example on its homepage) only with your consent, given and withdrawn in your Account preferences. Being featured, or not, is never a judgement of your work.
4. Taking your archive with you
You can download your archive at any time while your account is active: your records as a spreadsheet, your images and documents organised by work, in formats that open without Make Art Werk. You can import it again later and continue where you left off.
5. Trials, subscription and leaving
A trial is offered at Make Art Werk’s discretion, for a fixed length (for example 1 month) or open-ended. An open-ended trial isn’t permanent: it can be reviewed or ended. After a trial, billing follows the plan you choose. A failed payment doesn’t close your account straight away: you get time to resolve it.
If your account is closed, by you or by us, your full archive is emailed to you first, and stays available to download for 1 month (30 days). After that, your data is deleted or anonymised, except what the law requires us to keep longer (for example billing records for tax).
6. Your personal data
We use the personal data on your account to run the service. You can ask to see, correct, delete or receive a copy of it, and object to or limit how it is used: write to info@makeartwerk.com. The full detail (who processes it, where it is stored, how long it is kept) is in the Privacy notice.
Some things are optional and need your consent, which you can withdraw at any time in your Account preferences: for example being featured on the homepage or listed in the artists directory.
7. Your responsibilities
You are responsible for what you upload: that your information (titles, dates, sizes, prices) is accurate, and that you have the right to upload and show it, including photographs, other people’s material and the links you add. Having a file, such as a photograph of someone else’s work, doesn’t give you the right to publish it.
Make Art Werk does not authenticate works or check ownership, authorship or provenance. What you record about them is your own statement.
8. What isn’t allowed
Nudity and mature themes in genuine artistic, documentary or cultural work are allowed. Not allowed: pornography, any sexual content involving minors, non-consensual intimate images, sexual exploitation, or anything else illegal.
9. Removing content and suspending accounts
Make Art Werk may remove illegal or prohibited content, respond to copyright complaints, and suspend an account where necessary. Where the law requires it (notably the EU Digital Services Act), this follows a notice-and-action process, and you can contest a decision by writing to us.
10. Keeping your data safe
Regular backups are made, and we take reasonable technical and organisational measures to keep the service running and your data intact. We can’t guarantee the service will never be interrupted, or that data will never be lost or damaged. To make sure you don’t lose your data, keep your own backup, or automate it, and update it regularly: the archive download (section 4) is there for that.
11. Links and enquiries
Your page may link to other services (Instagram, your website, a shop). We aren’t responsible for them. When a visitor contacts you through Make Art Werk, we don’t become part of any agreement between you: negotiation, payment, delivery, taxes, refunds and any dispute are between you and them.
12. Liability
The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. Make Art Werk is not liable for information that is lost, damaged or unavailable, whatever the cause, beyond what the law requires.
To the maximum extent permitted by law, Make Art Werk’s total liability to you for any claim is limited to the amount you paid in the 12 months before the claim arose (or nothing, during a free trial or on a free plan). Make Art Werk is not liable for indirect or consequential damages, or for lost profits, sales or opportunities.
You agree to indemnify Make Art Werkagainst claims, damages or costs arising from content you upload, your breach of these Terms, or your violation of someone else’s rights.
Nothing in these Terms limits liability that the law does not allow us to limit, including your rights as a consumer in the EU, the UK or elsewhere. Where a clause above would go further than that law allows, it applies only as far as the law permits.
[Placeholder: the figures, wording and enforceability of this section need confirmation by counsel.]
13. Governing law
These Terms are governed by French law, and disputes go before the competent French courts, without affecting any consumer-protection rights you have where you live. If you are a consumer in the EU/EEA, you can also bring a claim in the courts of your own country.
[Placeholder: final jurisdiction, and any clause needed for users outside the EU/EEA, pending confirmation by counsel.]
14. Changes and contact
These Terms may change as the service develops. Each material change gets a new version date at the top of this page. Questions, or requests about your personal data: info@makeartwerk.com.
